Eleanor Holmes Norton (D-DC) on Tuesday sent a letter to the head of the Department of Housing and Urban Development (HUD), imploring her to use \u201cexecutive discretion\u201d to not enforce policies that prohibit cannabis use in federally assisted housing in states that have enacted legalization.<\/p>\n<p>The congresswoman wrote to HUD Secretary Marcia Fudge two weeks after filing legislation that would <a href=\"https:\/\/www.marijuanamoment.net\/congressional-bill-filed-to-protect-marijuana-consumers-from-losing-public-housing\/\" target=\"_blank\" rel=\"noopener\">legislatively accomplish the same objective<\/a>.<\/p>\n<p>\u201cIndividuals living in federally assisted housing should not be denied admission, or face eviction, for using a legal product,\u201d the congresswoman wrote. \u201cAdult use and\/or medical marijuana is currently legal in 36 states and the District of Columbia, and over 90 percent of Americans support legalized medical marijuana.\u201d<\/p>\n<p>\u201cThe federal government has begun to change its approach to marijuana,\u201d Norton said, adding that Congress has consistently included language in appropriations legislation in recent years that prohibits the Department of Justice (DOJ) from using its funds to interfere in the implementation of state-level medical cannabis laws.<\/p>\n<p>\u201cHUD, like DOJ, should not enforce federal marijuana laws where states have taken action to legalize marijuana,\u201d she said. \u201cSmoking marijuana in federally assisted housing should be treated in the same manner as smoking tobacco in federally assisted housing.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">No one should be denied admission to or face eviction from housing simply for treating their medical conditions or using a substance legal under state law.<\/p>\n<p>Release: <a href=\"https:\/\/t.co\/fmCs5ZDG83\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/fmCs5ZDG83<\/a><\/p>\n<p>\u2014 Eleanor #DCStatehood Holmes Norton (@EleanorNorton) <a href=\"https:\/\/twitter.com\/EleanorNorton\/status\/1397255662233587713?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">May 25, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>The <a href=\"https:\/\/norton.house.gov\/media-center\/press-releases\/norton-requests-hud-permit-marijuana-in-public-housing\" target=\"_blank\" rel=\"noopener\">letter<\/a> includes a request for a response from fudge, who previously served in Congress, by June 21.<\/p>\n<p>Norton\u2019s related bill would provide protections for people living in public housing or Section 8 housing from being displaced simply for using cannabis in states that have legalized it for medical or recreational purposes.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/3212\/\" target=\"_blank\" rel=\"noopener\">legislation<\/a> would also require the HUD secretary to enact regulations that restrict smoking marijuana at these properties in the same way that tobacco is handled.<\/p>\n<p>Norton\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/people-could-use-marijuana-in-public-housing-under-new-congressional-bill\/\" target=\"_blank\" rel=\"noopener\">filed earlier versions of<\/a>\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressional-bill-would-allow-marijuana-use-in-public-housing\/\" target=\"_blank\" rel=\"noopener\">the Marijuana in Federally Assisted Housing Parity Act<\/a>\u00a0in 2018 and 2019, but they did not receive hearings or votes.<\/p>\n<p>In 2018, a Trump administration official said that she was working to resolve conflicting federal and state marijuana laws\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trump-official-wants-to-legally-permit-medical-marijuana-in-federally-subsidized-housing\/\" target=\"_blank\" rel=\"noopener\">as it applies to residency<\/a>\u00a0in federally-subsidized housing, but it\u2019s not clear what came of that effort.<\/p>\n<p>Rep. Alexandria Ocasio-Cortez (D-NY) also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/alexandria-ocasio-cortez-presses-housing-secretary-about-marijuana-eviction-policies\/\" target=\"_blank\" rel=\"noopener\">raised the issue during a committee hearing<\/a>\u00a0in 2019, pressing former HUD Secretary Ben Carson on policies that cause public housing residents and their families to be evicted for committing low-level offenses such as marijuana possession.<\/p>\n<p>She pointed to two specific HUD policies: the \u201cone strike\u201d rule, which allows property managers to evict people living in federally assisted housing if they engage in illicit drug use or other crimes, and the \u201cno fault\u201d rule, which stipulates that public housing residents can be evicted due to illicit drug use by other members of their household or guests\u2014even if the resident was unaware of the activity.<\/p>\n<p>Ocasio-Cortez and then-Sen. Kamala Harris (D-CA) also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/aoc-and-kamala-harris-file-bill-protecting-drug-offenders-from-losing-public-housing\/\" target=\"_blank\" rel=\"noopener\">filed legislation that year<\/a>\u00a0that would protect people with low-level drug convictions from being denied access to or being evicted from public housing.<\/p>\n<p>Sen.
