{"id":43760,"date":"2020-07-24T12:06:17","date_gmt":"2020-07-24T20:06:17","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2020\/07\/24\/congressional-measure-allows-military-to-use-cbd\/"},"modified":"2020-07-24T13:47:06","modified_gmt":"2020-07-24T21:47:06","slug":"congressional-measure-allows-military-to-use-cbd","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2020\/07\/24\/congressional-measure-allows-military-to-use-cbd\/","title":{"rendered":"Congressional Measure Allows Military to Use CBD"},"content":{"rendered":"<\/p>\n<p>The U.S.\u00a0House of Representatives on July 20 voted 336 to 71 to approve a package of amendments to the National Defense Authorization Act\u2014including one that would allow military personnel to consume CBD and other hemp-derived products.\u00a0<\/p>\n<p>\u201cThe Secretary of Defense may not prohibit, on the basis of a product containing hemp or any ingredient derived from hemp, the possession, use, or consumption of such product by a member of the Armed Forces,\u201d reads the amendment, sponsored by Hawaii\u2019s\u00a0<a href=\"https:\/\/www.freedomleaf.com\/tulsi-gabbard-friend-of-cannabis-bashar-assad\/\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">controversial<\/a>\u00a0Rep. Tulsi Gabbard, a Democrat.<\/p>\n<p>A related measure would allow the heads of the four branches of the military to issue reenlistment waivers for those who admit to having used cannabis or were convicted of a misdemeanor marijuana offense. That measure, introduced by Rep. Ruben Gallego of Arizona, would allow waivers to be granted on a case-by-case basis, <a href=\"https:\/\/www.newsweek.com\/cbd-products-ndaa-2021-amendments-cannabis-sativa-tulsi-gabbard-1519490\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">Newsweek<\/a> reports. \u00a0<\/p>\n<p>As\u00a0<a aria-label=\"undefined (opens in a new tab)\" href=\"https:\/\/www.marijuanamoment.net\/congress-approves-measure-allowing-cbd-use-by-military-service-members\/\" target=\"_blank\" rel=\"noreferrer noopener\">Marijuana Moment<\/a>\u00a0points out, it remains to be seen whether either amendment will make it into the Senate version of the NDAA. But a bipartisan group of senators is trying to attach a cannabis research provision into the defense spending bill. That measure, a rider unrelated to the military, is called the Cannabidiol &amp; Marihuana Research Expansion Act.<\/p>\n<p>Senators Dianne Feinstein (D-CA), Chuck Grassley (R-IA) and Brian Schatz (D-HI) are pushing the bill, an effort which may be indicative of hope in the upper House for passing measures corresponding to those introduced by Gabbard and Gallego.<\/p>\n<h4><strong>Response to Pentagon Intolerance<\/strong><\/h4>\n<p>Gabbard\u2019s move comes in response to a CBD crackdown by Pentagon brass.\u00a0As\u00a0<a href=\"https:\/\/www.military.com\/daily-news\/2020\/06\/24\/pentagon-quietly-moves-make-cbd-use-criminal-offense-troops.html\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">Military.com<\/a>\u00a0reports, Acting Under Secretary of Defense for Personnel &amp; Readiness Matthew Donovan in February directed all four branches to issue general orders or regulations prohibiting the use of cannabis-derived products.\u00a0<\/p>\n<p>Donovan\u2019s\u00a0<a href=\"https:\/\/www.opss.org\/sites\/default\/files\/downloadable\/Adoption%20of%20Punitive%20General%20Orders%20to%20Address%20Use%20of%20Hemp%20Products%20%2826Feb2020%29%20OCR.pdf\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">memo<\/a>\u00a0cited the supposed threat to \u201cthe integrity of the drug testing program\u201d posed by CBD use (a dubious proposition, as legal CBD products contain little to no THC), and\u00a0indicated that the regulations must be enforceable under\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/10\/892\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">Article 92<\/a>\u00a0of the Uniform Code of Military Justice. This is the article that imposes court-martial for failure to obey an order.\u00a0<\/p>\n<p>The Army and Air Force both issued such regulations last year. But members of the Navy and Marine Corps were allowed under Department of the Navy regulations to use topical products such as shampoo, lotions and creams.<\/p>\n<p>Donovan\u2019s memo did carve out certain exceptions, including ingestion unawares and use of FDA-approved medications such as Epidiolex, Marinol and Syndros.<\/p>\n<h4><strong>PTSD\u00a0Potential<\/strong><\/h4>\n<p>Gabbard\u2019s amendment is especially significant in light of the potential shown by cannabinoids for treatment of post-traumatic stress syndrome, or PTSD\u2014clearly a question of concern to service members.\u00a0<\/p>\n<p>There was a positive response from figures in the cannabis industry who have been exploring the use of preparations to treat PTSD.<\/p>\n<p>\u201cThis is a long overdue, but an exciting opportunity for our active military to have access to state-of-the-art CBD products to help them manage chronic pain as well as anxiety and PTSD challenges,\u201d Ed Donnelly, founder of\u00a0<a href=\"https:\/\/amourcbd.com\/\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">AmourCBD<\/a>, told\u00a0<a href=\"https:\/\/www.newsweek.com\/cbd-products-ndaa-2021-amendments-cannabis-sativa-tulsi-gabbard-1519490\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">Newsweek<\/a>.<\/p>\n<p>His Illinois-based company markets CBD oils, edibles and creams to first responders and veterans. \u201cCBD and hemp products can help our valued warriors enjoy the quality of life they deserve.\u201d<\/p>\n<p>The percentage of military veterans facing challenges from PTSD is staggering, but the Department of Veterans Affairs remains intransigent on allowing access to cannabis\u2014the only treatment that provides relief for many.
