{"id":40270,"date":"2019-12-25T06:00:47","date_gmt":"2019-12-25T14:00:47","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2019\/12\/25\/how-to-give-weed-away-for-free\/"},"modified":"2019-12-25T12:48:07","modified_gmt":"2019-12-25T20:48:07","slug":"how-to-give-weed-away-for-free","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2019\/12\/25\/how-to-give-weed-away-for-free\/","title":{"rendered":"How to Give Weed Away for Free"},"content":{"rendered":"<\/p>\n<p>Last Christmas, the gift idea of the season in certain corners of Michigan was cannabis \u2014 because buying a $100 chocolate bar, or $200 t-shirt, or some other absurdly priced, everyday item and then receiving $100 or $200 worth of weed as a \u201cgift\u201d <a href=\"https:\/\/fox17online.com\/2018\/12\/28\/grand-rapids-attorney-clarifies-marijuana-gifting-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">was how the (somewhat) legal market worked<\/a>. <\/p>\n<p>(Turns out <a href=\"https:\/\/www.mlive.com\/news\/ann-arbor\/2018\/12\/buy-some-chocolate-get-some-weed-says-new-ann-arbor-business.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cbuy some chocolate, get some weed\u201d<\/a> was an effective sales pitch.) <\/p>\n<p>In Washington, D.C., where voters legalized cannabis but lawmakers from Texas and elsewhere still make rules in Congress such convoluted \u201cgifting\u201d schemes are technically the <a href=\"https:\/\/qz.com\/1615820\/the-safe-cannabis-sales-act-could-end-dcs-weed-gifting-economy\/\" target=\"_blank\" rel=\"noreferrer noopener\">only way you can legally exchange cash for weed<\/a>, and will be so for the foreseeable future.<\/p>\n<p \/>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">70 percent of the District of Columbia legalized cannabis use in 2014. Because DC is a federal district, though, and not a state, the U.S. government exercises more control over its finances. Use, growing and gifting is allowed \u2013 not manufact. or sales. <a href=\"https:\/\/t.co\/D4kzDKO7wx\">https:\/\/t.co\/D4kzDKO7wx<\/a><\/p>\n<p>\u2014 Natalie Fertig (@natsfert) <a href=\"https:\/\/twitter.com\/natsfert\/status\/1206721435454070787?ref_src=twsrc%5Etfw\">December 16, 2019<\/a><\/p><\/blockquote>\n<p>But most gifts are for actual<br \/>\ngiving \u2014 as in there\u2019s no exchange of cash for goods involved, a ritualized<br \/>\ntradition that helps our market economy move every year around this time \u2014 which<br \/>\nbegs a question: Can you give someone cannabis for Hannukah, or Christmas, or<br \/>\nKwanzaa, or just because? <\/p>\n<p>The answer is absolutely,<br \/>\nmostly, but there are some limitations to keep in mind, depending on where you<br \/>\nlive and to whom you\u2019re giving.<\/p>\n<h4>The Art &amp; Science of Gifting Weed<\/h4>\n<p>Size-wise at least, cannabis<br \/>\nmakes an ideal gift. Jars are easy to wrap (and make fine vessels for other<br \/>\ncommodities once the contents are rolled up and smoked away), pre-rolls and<br \/>\nedibles fit in pockets as well as they fit in stockings or small boxes.<br \/>\nCannabis is also popular, and if not legalized, at least decriminalized in most<br \/>\nplaces. You probably won\u2019t shock or stigmatize your relatives or co-workers if<br \/>\nyou gifted them a few grams from your home-grow, or dipped into the dispensary<br \/>\non the way to the workplace gift swap to grab a chocolate bar \u2014 though if you<br \/>\nwork at a school or children\u2019s day-care, you risk both offending your officious<br \/>\nacquaintances and running afoul of the law.<\/p>\n<h4>Rule: It Must Be a Gift<\/h4>\n<p>Obviously, if cannabis is not<br \/>\nyet legal in your state, or if cannabis is legal only with a medical-cannabis<br \/>\nrecommendation, two people who are not patients can\u2019t legally exchange weed (though<br \/>\nit\u2019s the possession itself and not the exchange, for no compensation, that\u2019s<br \/>\nthe violation). <\/p>\n<p>But since legal cannabis is<br \/>\nnew and cannabis laws are restrictive \u2014 more restrictive than laws around<br \/>\nalcohol or cigarettes, two substances to which weed is (unfairly) often compared<br \/>\n\u2014 gifting weed is a valuable technique beyond the holidays, because in most<br \/>\nsituations and in most states, Michigan among them, the only way to transfer<br \/>\ncannabis from one person to another outside of the legal framework is with a<br \/>\ngift. <\/p>\n<p>(In situations when the<br \/>\nmonetary exchange is intended to cover the giver\u2019s labor and materials, the<br \/>\nquestion gets fuzzier, but since this is a gifting guide and not a sales guide,<br \/>\nit\u2019s not our concern.)<\/p>\n<p>And<br \/>\nif you want to be legal \u2014 who doesn\u2019t \u2014 you need to obey other quirks of local<br \/>\nlaw as well.<\/p>\n<h4>Rule: It Can\u2019t Be Too Much<\/h4>\n<p>Every state that\u2019s legalized cannabis has also established legal possession limits. These range, usually, from about one to two ounces. <\/p>\n<p>In places where cannabis is<br \/>\nlegal, how much you can give away depends on the possession limit in your<br \/>\nparticular legal jurisdiction. Adults 21 and over in California, for example,<br \/>\nare allowed to possess up to 28.5 grams of cannabis flower \u2014 that is, exactly<br \/>\none ounce \u2014 and 8 grams of concentrates.<\/p>\n<p>In Michigan, \u201cit is not unlawful to give away or otherwise transfer without remuneration, that is without compensation, up to 2.5 ounces of marijuana to a person 21 years of age or older as long as the transfer is not advertised or promoted to the public,\u201d <a href=\"https:\/\/fox17online.com\/2018\/12\/28\/grand-rapids-attorney-clarifies-marijuana-gifting-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">as attorney Bob Hendricks explained to Fox-17 last year.<\/a> <\/p>\n<p>In California, \u201c[t]here is nothing to worry about when it comes to adults giving away cannabis to other adults ages 21 and over for the holidays, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=HSC&amp;sectionNum=11362.1&amp;fbclid=IwAR2aJG3fwc4NZbRbNdkUepTw4Z0hEaEF-nVeMdb_KMVgu30qkpLwLvE9so4\" target=\"_blank\" rel=\"noreferrer noopener\">as long as the quantities are within the limits of up to 28.5 grams of cannabis and 8 grams of concentrated cannabis<\/a>,\u201d as longtime cannabis attorney Omar Figueroa told Cannabis Now. <\/p>\n<h4>Rule: They Can\u2019t Be Too Young<\/h4>\n<p>This should go without saying, but under all circumstances you must resist any urges to be the cool aunt, or the cool cousin, or the cool whatever, if you believe giving weed to someone under 21 is a cool act \u2014 because in addition to being sort of sleazy, giving cannabis to someone under 21 (or, much worse, under 18) is one of the few cannabis-related acts that carry severe penalties, including prison, in a legal state. Handing a joint to a 17-year-old could lead to a felony charge. As attorney Vikras Bajaj <a rel=\"noreferrer noopener\" href=\"https:\/\/www.bajajdefense.com\/can-i-give-marijuana-as-a-gift\/\" target=\"_blank\">pointed out<\/a>, the gift can also have serious implications for the receiver: They could be forced to pay a fine or complete community service just because you gave them weed. Don\u2019t do it.<\/p>\n<h4>Other Rules Apply<\/h4>\n<p>By now, you probably get the idea: There are some laws to follow when gifting weed, just like there are rules to follow if you wanted to gift someone a carton of cigarettes, a nugget of plutonium, or other substances on which the government has affixed certain restrictions. As much as a box filled with sungrown <a href=\"\/return-of-the-mac\/\">MAC<\/a> from Mendocino might be welcomed in Massachusetts, <a href=\"https:\/\/www.nbcsandiego.com\/news\/local\/the-dos-and-donts-when-giving-marijuana-as-a-holiday-present\/2044112\/\" target=\"_blank\" rel=\"noreferrer noopener\">crossing state lines with legal cannabis is illegal<\/a>! And we, as a cannabis publication, could never endorse conduct that is not legal. We just couldn\u2019t. No. Can\u2019t. Won\u2019t. <\/p>\n<h4>Know the Givee<\/h4>\n<p>Finally, try to obey the<br \/>\nnormal and sensible rules of gift-giving. Is giving this weed an appropriate<br \/>\ngift? Well, does the recipient like weed? Maybe that will dictate whether you<br \/>\ntry out a high-CBD vape pen on mom or dad or bother with a weak edible to your<br \/>\ndabbed-out Wookie cousin.<\/p>\n<p>You would not \u2014 or at least you should not \u2014 waste time and resources giving someone stuff they don\u2019t need. Just as you would not give a Cutco set to a chef with a vast array of knives and you would not bother giving a sommelier a bottle of Charles Shaw (except as an ironic joke that still quickly wears thin) you wouldn\u2019t offend an Emerald Cup-winning grower or a total weed snob with a jar of boof, unless you thought it was funny.<\/p>\n<p>\u201cI would be delighted if<br \/>\ngifted huge sparkling colas of biodynamic cannabis for the holidays!\u201d Figueroa<br \/>\nsaid. \u201cBranded mids?
