Charlie Baker\u00a0<a href=\"https:\/\/www.npr.org\/2019\/09\/25\/764135117\/mass-gov-charlie-baker-announces-ban-on-all-vaping-products\" target=\"_blank\" rel=\"noreferrer noopener\">in September imposed<\/a>\u00a0a four-month ban on legal sales of all vapes, cannabis and nicotine alike.<\/p>\n<p>What impact Baker\u2019s ban has had on public health is unclear. Nearly all available evidence now points to underground, illicit vaporizer products as the vector, an early hypothesis now supported by the federal Centers for Disease Control, but medical cannabis patients, at least, could see that ban lifted as soon as Nov. 12.<\/p>\n<p>However, as\u00a0<a href=\"https:\/\/www.wbur.org\/commonhealth\/2019\/11\/07\/cannabis-vaping-products-access-baker-challenge-regulations\" target=\"_blank\" rel=\"noreferrer noopener\">Boston-based WBUR reported<\/a>, vaporizer cartridges may yet be subjected to stricter controls, including bans.<\/p>\n<p>Baker\u2019s ban was immediately challenged in the courts. Earlier this week, a state Superior Court judge\u00a0<a href=\"https:\/\/www.wbur.org\/commonhealth\/2019\/11\/05\/medical-marijuana-ccc-authority-dph-baker-vape-sales-ruling\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a>\u00a0that Baker exceeded his authority when imposing the ban. Only the state Cannabis Control Commission had the authority to regulate or halt sales of cannabis products and during its public meeting on Thursday, the CCC declined to do that.<\/p>\n<p>Instead, the CCC\u2019s five commissioners voted to revamp state cannabis regulations, which means that for medical cannabis patients, the ban is now set to expire on Nov. 12. At that time, medical cannabis patients should be allowed to purchase flower-based vaporizers, which are currently not suspected in any lung-injury.<\/p>\n<p>For everyone else (and for anyone jonesing for a Juul pod or other nicotine vaporizer) the ban now expires Dec. 24.<\/p>\n<p>It\u2019s still possible that Massachusetts cannabis customers, recreational and medical alike, will be unable to purchase vaporizer cartridges next week and beyond, pending the outcome of an appeal on the earlier ruling filed by the Baker administration.<\/p>\n<p>Over the long-term, however, state regulators will now attempt to craft rules \u201cbased on science\u201d following public input, according to Commissioner Shaleen Title, who was quick to denounce Baker\u2019s initial ban as a reactionary over-reach.<\/p>\n<p>Future rules could mean bans or restrictions on various cannabis products, depending on potency or formulation. Or not! It all \u201cdepends on what the evidence shows,\u201d\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/twitter.com\/shaleentitle\/status\/1192851271461552136\" target=\"_blank\">as Title posted on Twitter today,<\/a> or what the state Legislature chooses to do.<\/p>\n<p>\u201cIt is possible that there may be enough credible evidence to warrant a quarantine of non-flower THC vapes,\u201d she wrote. \u201cEither way, regulations with appropriate public input are in process.\u201d<\/p>\n<figure class=\"wp-block-embed-twitter wp-block-embed is-type-rich is-provider-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">I can\u2019t easily predict what will happen with oil and cartridge vapes. If it stays up to the CCC, it will depend on what the evidence shows. It also depends on how the court rules on the motion to stay or on the appeal of the decision.<\/p>\n<p>\u2014 Shaleen Title (@shaleentitle) <a href=\"https:\/\/twitter.com\/shaleentitle\/status\/1192851271461552136?ref_src=twsrc%5Etfw\">November 8, 2019<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p>Though \u201cno one cause\u201d has yet been identified, today, the federal Centers for Disease Control and Prevention issued a\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.cdc.gov\/media\/releases\/2019\/p0906-vaping-related-illness.html\" target=\"_blank\">bulletin<\/a>\u00a0confirming what many researchers and advocates had suspected from nearly the beginning: Lab tests from lung fluid collected from patients in 10 states all revealed an oily additive called vitamin E acetate.<\/p>\n<p>As\u00a0<a href=\"https:\/\/www.leafly.com\/news\/health\/toxic-vaping-vapi-evali-lung-injury-rise-and-fall-of-vitamin-e-oil-honey-cut\" target=\"_blank\" rel=\"noreferrer noopener\">Leafly News<\/a>\u00a0was the first to report, vitamin E acetate \u2014 safe to eat but not to breathe \u2014 is the main ingredient in diluting agents like Honey Cut.<\/p>\n<p>Data showing where and when the lung injuries were reported reveal that there are far more cases per capita in states where cannabis is illegal than in legal states, strongly suggesting that unscrupulous underground merchants cutting THC oil with additives like Honey Cut are responsible for the vaping deaths, not regulated dispensaries, as several\u00a0<a href=\"\/legal-pot-isnt-villain-in-vape-disease-epidemic-but-it-could-be-the-solution\/\">prohibitionist zealots were quick to allege<\/a>, without any supporting evidence.<\/p>\n<p>When they\u2019re crafted, Massachusetts\u2019s new rules will likely ban additives like vitamin E acetate. They may also set other product safety standards so as to avoid a repeat of this crisis.
