{"id":37723,"date":"2019-08-21T09:06:47","date_gmt":"2019-08-21T17:06:47","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2019\/08\/21\/feds-hemp-businesses-can-use-credit-unions\/"},"modified":"2019-08-25T12:48:15","modified_gmt":"2019-08-25T20:48:15","slug":"feds-hemp-businesses-can-use-credit-unions","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2019\/08\/21\/feds-hemp-businesses-can-use-credit-unions\/","title":{"rendered":"Feds: Hemp Businesses Can Use Credit Unions"},"content":{"rendered":"<\/p>\n<p>Hemp, marijuana\u2019s taxonomically identical twin and the source material for the CBD products found anywhere there is money to be made in America, is legal \u2014 but not 100% legal.<\/p>\n<p>Last year\u2019s\u00a0<a href=\"\/hemp-legalized-in-usa-after-decades-of-prohibition\/\">Farm Bill<\/a>\u00a0very explicitly legalized the cultivation, production, and sale of industrial hemp \u2014\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.bostonglobe.com\/news\/marijuana\/2018\/12\/11\/mitch-mcconnell-used-hemp-pen-sign-farm-bill-legalizing-crop\/e9bEn4oAOghNAs3v8DFkKO\/story.html\" target=\"_blank\">look, see, there is Sen. Mitch McConnell waving a hemp pen!<\/a>\u00a0\u2014 but many hemp farmers and entrepreneurs\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.wrvo.org\/post\/hemp-farmers-struggle-rejection-banks-social-media-ads\" target=\"_blank\">are suffering the cannabis treatment<\/a> despite dealing with a product that is legal in 50 states (and advertised for sale on Amazon, and almost everywhere else).<\/p>\n<p>Facebook and Instagram are rejecting hemp businesses\u2019 ads. Police and highway patrol are intercepting their interstate shipments. And banks, credit-card companies, and payroll firms are refusing their business \u2014 not because the federal government was threatening financial-services companies, but (and please bear with us) because the federal government\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/hempindustrydaily.com\/hemp-companies-left-looking-for-banking-alternatives\/\" target=\"_blank\">wasn\u2019t explicitly saying it was OK to do business with a legal business<\/a>,\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.wivb.com\/news\/new-york\/sen-schumer-wants-to-make-it-easier-for-nys-hemp-farmers-to-get-funding\/\" target=\"_blank\">despite U.S. senators and other bigwigs asking them very nicely to say it<\/a>.<\/p>\n<p>As of Monday, after\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-reserve-official-pledges-to-tell-banks-they-can-service-hemp-businesses\/\" target=\"_blank\" rel=\"noreferrer noopener\">promising to say<\/a>, publicly, that hemp businesses are legal and financial institutions can take their money, the feds\u00a0<em>are<\/em>\u00a0saying this.<\/p>\n<p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.marijuanamoment.net\/credit-unions-can-bank-hemp-businesses-federal-agency-announces\/\" target=\"_blank\">As Marijuana Moment reported<\/a>, <a rel=\"noreferrer noopener\" href=\"https:\/\/www.ncua.gov\/\" target=\"_blank\">the National Credit Union Administration<\/a>, a federal agency that regulates and ensures the for-profit banking alternatives,\u00a0<a href=\"https:\/\/www.ncua.gov\/newsroom\/press-release\/2019\/ncua-releases-interim-guidance-serving-hemp-businesses\" target=\"_blank\" rel=\"noreferrer noopener\">issued a press release<\/a>\u00a0in which it clarified that credit unions can in fact provide \u201ccertain financial services\u201d to \u201clawful hemp businesses.\u201d<\/p>\n<p>Sort of like how they do with every other lawful business!<\/p>\n<p>\u201cCredit unions will be able to provide the customary range of financial services for business accounts, including loans, to hemp businesses within their fields of membership,\u201d according to the agency\u2019s press release.<\/p>\n<p>All a hemp business needs to do in order to go to the credit union and come away with a loan or a credit union account is follow the law. All the credit union needs to do is make sure that their prospective client is doing so (verifying that the hemp business is in fact complying with the Farm Bill, for example) while also complying with federal laws requiring banking institutions to monitor client activity and report suspicious activity to the federal government.<\/p>\n<p>Along with New York Sen. Chuck Schumer and Kentucky\u2019s McConnell, Sen. Michael Bennet, a Democrat from Colorado and a presidential contender (insofar as he continues to qualify for debates), has been pestering federal agencies to provide some guidelines for baffled hemp businesses who find themselves turned down at the bank.<\/p>\n<p>Monday\u2019s guidance is \u201cinterim,\u201d meaning that it will likely change once federal agencies like the United States Department of Agriculture issue updated guidelines on hemp production. In essence, saying for a second time, in very clear language that will please attorneys and risk-averse executives, that growing hemp in the U.S. is OK.<\/p>\n<p>Of course, just because a credit union can do business with hemp farmers or producers doesn\u2019t mean that they will. And in other to obtain the most favorable rates for a loan, hemp entrepreneurs would benefit from competition \u2014 like competition for their business from banks, who are still sitting on the fence, and who Schumer last week vowed he would continue to pressure.<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/five-federal-agencies-respond-to-presidential-candidates-hemp-banking-letter\/\" target=\"_blank\" rel=\"noreferrer noopener\">As Marijuana Moment reported last week,<\/a>\u00a0most financial institutions will likely wait until Agriculture Secretary Sonny Purdue issues clarified rules sometime before next spring.<\/p>\n<p>Why has this been so hard? Maybe for the same reason why the burgeoning hemp industry has apparently broken the brains and drug-testing kits of police and prosecutors in prohibition-minded areas.
