Jared Polis last week signed into law a measure long sought by Centennial State cannabis advocates, allowing businesses to apply for licenses for \u201csocial use\u201d spaces, which opens the way for Amsterdam-style coffeeshops or smoking lounges.<\/p>\n<p><a rel=\"noreferrer noopener\" href=\"https:\/\/leg.colorado.gov\/sites\/default\/files\/documents\/2019A\/bills\/2019a_1230_enr.pdf\" target=\"_blank\">House Bill 19-1230\u00a0<\/a>authorizes consumption of cannabis in licensed \u201cMarijuana Hospitality Establishments.\u201d\u00a0<\/p>\n<p>\u201cColorado has many tourists and residents who choose to participate [in legal cannabis use]. Up until this bill, there\u2019s been no way to have safe public consumption,\u201d Polis said before\u00a0<a href=\"https:\/\/www.jurist.org\/news\/2019\/05\/colorado-defelonizes-certain-drug-possession-allows-businesses-to-permit-social-marijuana-use\/\" target=\"_blank\" rel=\"noreferrer noopener\">signing<\/a>\u00a0the bill on May 28.\u00a0<\/p>\n<p>In a line that seemed shrewdly crafted to appease cultural conservatives uncomfortable with public use, he added: \u201cI\u2019ve smelled it walking my dog. For many of us with kids, we want to make sure we don\u2019t have that in our neighborhoods.\u201d<\/p>\n<h4>Denver: Amsterdam in the Rockies?<\/h4>\n<p>As\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.westword.com\/marijuana\/colorado-governor-signs-bill-legalizing-marijuana-cafes-lounges-and-other-social-use-areas-11360517\" target=\"_blank\">Westword<\/a>\u00a0reports, Colorado dispensaries will be now able to apply for tasting-room licenses similar to those issued for breweries, while other businesses will be able to apply for private consumption licenses and limited on-site sales. Mobile \u201cmarijuana lounges\u201d such as tour buses and limousines will also be licensed but will not be authorized to sell cannabis. Temporary licenses for special events will also be available.<\/p>\n<p>At least one boutique hotel in Denver, the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.pattersoninn.com\/en-us\" target=\"_blank\">Patterson Inn<\/a>, is said to be interested in the idea of applying for a new license. Owner Chris Chiari currently allows his guests to smoke cannabis on their private outdoor patios or vape in their rooms at the nine-room bed-and-breakfast in Denver\u2019s bohemian-flavored Capitol Hill neighborhood. \u201cI would love to be able to carve out a space for the guests in the hotel \u2014 I already have a specific room in my mind,\u201d he testified in support of the measure per a\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.westword.com\/marijuana\/colorado-house-committee-approves-bill-allowing-marijuana-use-in-hotels-dispensaries-and-other-businesses-11287211\" target=\"_blank\">Westword<\/a>\u00a0report in March.\u00a0<\/p>\n<p>Another\u00a0<a href=\"https:\/\/www.westword.com\/marijuana\/ten-colorado-businesses-that-should-allow-social-pot-use-now-that-its-approved-11365203\" target=\"_blank\" rel=\"noreferrer noopener\">Westworld<\/a>\u00a0article notes that beyond dispensaries and hotels, many other Denver businesses might apply for such licenses: restaurants, coffee shops, music venues, art galleries, bookstores and game arcades. One obstacle is that Marijuana Hospitality licenses and liquor licenses will be mutually exclusive for any one establishment \u2014 but that may not slow things down too much.<\/p>\n<p>\u201cGood luck finding a restaurant willing to part with its liquor license in favor of marijuana (even if it might help with food sales), but eateries without them could see an opportunity,\u201d Westword writes. \u201cAnd restaurants with an active liquor license could conceivably pause their liquor licenses for a night or two if they ever wanted to try out a pot-friendly atmosphere. There\u2019s also the option of getting a social pot use license for a neighboring property.\u201d<\/p>\n<p>Advocates have sought to get a \u201csocial use\u201d measure passed every year since 2013 (the year after Colorado voted to legalize). The \u201csocial use\u201d bill that was\u00a0<a href=\"\/big-pharma-bill-considered-in-colorado\/\">introduced<\/a>\u00a0a year ago was vetoed by then-governor John Hickenlooper. Meanwhile, another state beat Colorado to the punch as the first to allow \u201csocial use.\u201d With approval of new regs earlier this year,\u00a0<a href=\"\/will-anchorage-be-the-next-amsterdam-alaska-to-allow-on-site-consumption\/\">Alaska become to the first state<\/a> to officially oversee cannabis use at licensed retail outlets.<\/p>\n<h4>Penalties Lowered for Illicit Quantities<\/h4>\n<p>Gov, Polis also signed two <a rel=\"noreferrer noopener\" href=\"https:\/\/blog.norml.org\/2019\/05\/30\/colorado-governor-signs-multiple-marijuana-law-reform-measures\/\" target=\"_blank\">related measures<\/a>\u00a0that day, including one that lowers penalties for cannabis possession in quantities exceeding those legalized by Amendment 64.\u00a0<br \/><a rel=\"noreferrer noopener\" href=\"https:\/\/leg.colorado.gov\/sites\/default\/files\/documents\/2019A\/bills\/2019a_1263_01.pdf\" target=\"_blank\"><br \/>House Bill 19-1263<\/a>\u00a0affects several controlled substances, including\u00a0flunitrazepam, ketamine and cathinones as well as cannabis. Where cannabis is concerned, the penalty for one-time personal possession of more than six ounces of herbaceous marijuana or more than three ounces of concentrate are dropped from a level 4 felony to a level 1 misdemeanor, punishable by a maximum $1,000 fine and up to two years probation. In most cases, there will be no jail time except for a violation of the terms of probation. The new penalties are to take effect on March 1, 2020.<\/p>\n<p><a rel=\"noreferrer noopener\" href=\"https:\/\/leg.colorado.gov\/bills\/hb19-1234\" target=\"_blank\">House Bill 1234<\/a> establishes regulations for the delivery of cannabis products from state-licensed retailers, as opposed to on-site purchases \u2014 a question still unresolved seven years after the approval of Amendment 64. Under the law, deliveries are limited to one per day per household, and only in municipalities that allow such activities. Deliveries to college campuses are prohibited.
