{"id":35741,"date":"2019-05-31T05:00:31","date_gmt":"2019-05-31T13:00:31","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2019\/05\/31\/the-fda-could-decide-today-if-cbd-in-your-food-is-legal-but-probably-wont\/"},"modified":"2019-06-02T12:43:05","modified_gmt":"2019-06-02T20:43:05","slug":"the-fda-could-decide-today-if-cbd-in-your-food-is-legal-but-probably-wont","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2019\/05\/31\/the-fda-could-decide-today-if-cbd-in-your-food-is-legal-but-probably-wont\/","title":{"rendered":"The FDA Could Decide Today If CBD in Your Food Is Legal (But Probably Won\u2019t)"},"content":{"rendered":"<\/p>\n<p>Later today, more than 140 people are scheduled to tell the federal Food and Drug Administration all about CBD.<\/p>\n<p>And in return, many, many more people across the country are hoping<br \/>\nthat the FDA will declare the non-intoxicating cannabis compound associated<br \/>\nwith healing and wellness benefits is OK \u2014 OK to add to food and drinks, and<br \/>\nthus OK to include in their pitch decks and business plans.<\/p>\n<p>Will they? Won\u2019t they? Nobody knows, but this is a major milestone in the Great CBD Craze, and has the potential to either halt or \u2014 more likely \u2014 inflame further the United States\u2019s <a href=\"\/its-time-to-tone-down-the-cbd-hype\/\">obsession<\/a> with <a href=\"\/the-cbd-phenomenon\/\">cannabidiol<\/a>.<\/p>\n<p>One of the more than 100 active cannabinoids in the cannabis plant, CBD was big and getting bigger before Donald Trump <a href=\"\/hemp-legalized-in-usa-after-decades-of-prohibition\/\">signed the 2018 Farm Bill into law<\/a> and legalized hemp cultivation outright. (Hemp and marijuana are both the plant cannabis sativa; hemp is defined as having less than 0.3 percent THC.)<\/p>\n<p>In the months since, a horde of entrepreneurs \u2014 <a rel=\"noreferrer noopener\" href=\"https:\/\/qz.com\/quartzy\/1301584\/at-gwyneth-paltrows-goop-summit-cbd-and-cannabis-products-were-in-the-gift-bags\/\" target=\"_blank\">including Gwyneth Paltrow<\/a> and her brand Goop, <a href=\"\/the-corporate-cannabinoid-cbd-arrives-at-walgreens-cvs\/\">legacy cosmetics brands including drugstore empire CVS<\/a> and local bookstores \u2014 have offered a horde CBD-infused products, some of which are being marketed with eyebrow-raising promises of guaranteed wellness benefits, of the kind once associated with patent medicines.<\/p>\n<p>They are doing this despite the FDA declaring CBD-infused food products outright illegal \u2014 which did not stop <a href=\"\/carls-jr-will-make-420-history-with-a-cbd-infused-burger\/\">Carl\u2019s Jr. from selling CBD-infused hamburgers<\/a> in Colorado \u2014 and despite some less scrupulous hucksters <a href=\"\/fda-issue-warning-letters-cbd-claims\/\">receiving official warnings<\/a> to stop promising people CBD will cure their cancer.<\/p>\n<p>The main reason why CBD is so popular and why so many people are so eager to tell the FDA to let them sell it is obvious. It\u2019s money. <a rel=\"noreferrer noopener\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-05-27\/u-s-reviews-cbd-amid-pressure-to-act-quickly-cannabis-weekly\" target=\"_blank\">As Bloomberg reported earlier this week<\/a>, demand for CBD is expected to balloon to as large as $15 billion within five years. Not to be outdone, Brightfield Group, another cannabis research firm, <a href=\"\/report-says-cbd-could-dominate-cannabis-market-by-2022\/\">put out a report<\/a> that the CBD market will be $22 billion strong by 2022.<\/p>\n<p>What will happen after today, after all the talking and the<br \/>\nlistening? According to Bloomberg, one likely outcome is a CBD ceiling.<\/p>\n<p>As the outlet pointed out, former FDA Commissioner Scott Gottlieb<br \/>\nworried openly if CBD added to numerous consumer products would not thwart the<br \/>\nFDA\u2019s normal \u201cdrug approval process\u201d and compel drug companies and commercial<br \/>\nentities to not bother paying for clinical trials to figure out what CBD does.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe FDA will likely cap CBD dosages for consumer products and let pharmaceutical companies have dominion over very high CBD products, like pills or other prescription-only products.\u201d<\/p>\n<\/blockquote>\n<p>Thus, opined Robert DiPisa, a New Jersey-based attorney who chairs<br \/>\nthe cannabis law group at firm Cole Schotz, the FDA will likely cap CBD dosages<br \/>\nfor consumer products and let pharmaceutical companies have dominion over very<br \/>\nhigh CBD products, like pills or other prescription-only products.<\/p>\n<p>If that happens, what\u2019s to stop someone from eating twenty<br \/>\n10-milligram CBD brownies to achieve the same non-high? Nothing, except the<br \/>\narduous task of eating that many brownies.<\/p>\n<p>Other producers, like Canopy Growth Corporation, which earlier this<br \/>\nyear announced plans to open up a massive hemp farm in New York State for the<br \/>\npurpose of extracting CBD, are simply hoping for some basic CBD regulations,<br \/>\nsuch as mandated and verified testing or product standards.<\/p>\n<p>Keep in mind that, currently, there is nothing stopping any company from throwing any hemp from any source into anything and declaring the product \u201cCBD rich!\u201d and thus healthy. When you consider that hemp is an effective phytoremediator \u2014 hemp <a href=\"https:\/\/thehempmag.com\/2018\/07\/radioactive-research-is-hemp-a-soil-savior\/\" target=\"_blank\" rel=\"noreferrer noopener\">was planted around the nuclear power plant at Chernobyl<\/a> in Ukraine to remove some of the radioactive contamination from the soil \u2014 that seems more than reasonable.<\/p>\n<p>Will the FDA deliver all this today? Almost certainly not. The FDA is scheduled to take public comment on CBD regulations through July 2, <a href=\"https:\/\/www.cnbc.com\/2019\/05\/30\/fda-kicks-off-review-of-cbd-at-first-public-hearing-friday.html\" target=\"_blank\" rel=\"noreferrer noopener\">according to CNBC<\/a>, and hasn\u2019t shown much desire to rush through regulations so far despite the madness in the market.<\/p>\n<p>It appears more than likely that Congress will have to pass a CBD<br \/>\nlaw, perhaps one that also clarifies that interstate trade in hemp is lawful.<\/p>\n<p>And not everyone is happy with CBD.
