But some say this provides an opportunity.<\/p>\n<p>With export across state lines presenting itself as an obvious solution, voices in the industry say the time may be ripe to push for federal approval of an interstate cannabis trade.<\/p>\n<h4>Harvests Getting Trashed?<\/h4>\n<p>Oregon\u2019s authorities are now documenting the well-known market saturation. The state\u2019s cannabis industry is already so overstocked that it could meet consumer demand for the next six and a half years, according to a recent\u00a0<a href=\"https:\/\/www.oregon.gov\/olcc\/marijuana\/Documents\/Bulletins\/2019%20Supply%20and%20Demand%20Legislative%20Report%20FINAL%20for%20Publication%28PDFA%29.pdf\" target=\"_blank\" rel=\"noopener\">analysis<\/a>\u00a0by the\u00a0<a href=\"https:\/\/www.oregon.gov\/olcc\/\" target=\"_blank\" rel=\"noopener\">Oregon Liquor Control Commission<\/a>. The study, based on data from three years of production and more than two years of legal sales, was turned in to lawmakers late last month.<\/p>\n<p>As\u00a0<a href=\"https:\/\/expo.oregonlive.com\/news\/g66l-2019\/02\/d05137b73d8055\/marijuana-supply-far-outweighs-demand-in-oregons-legal-market-new-study-says.html\" target=\"_blank\" rel=\"noopener\">The Oregonian<\/a>\u00a0notes, the study found that between July 2017 and June 2018, demand represented 50 percent of supply, with the remainder languishing in inventory. The state\u2019s licensed producers last year harvested upwards of 2,000 metric tons of cannabis \u2014 some 4.4 million pounds. And if the state approves all pending producer licenses, Oregon will be on track to churn out an estimated 4,000 metric tons this year.<\/p>\n<p>Licensed retail outlets supply only slightly more than half of the cannabis consumed in Oregon, the study found. About 45 percent of consumption comes from other sources, including home cultivation (with four plants per household permitted), the\u00a0<a href=\"\/tag\/oregon-medical-marijuana-program\/\">medical marijuana sector<\/a>\u00a0and the illicit market.<\/p>\n<p>And as the\u00a0<a href=\"https:\/\/www.heraldandnews.com\/breaking\/cannabis-industry-suffering-from-growing-pains\/article_3d2ccb59-655a-5334-890e-db71a8289e86.html\" target=\"_blank\" rel=\"noopener\">Bend Bulletin<\/a>\u00a0notes, the study immediately follows an audit by Oregon\u2019s\u00a0<a href=\"https:\/\/sos.oregon.gov\/\" target=\"_blank\" rel=\"noopener\">Secretary of State<\/a>\u00a0of how the Liquor Control Commission and\u00a0<a href=\"https:\/\/www.oregon.gov\/OHA\/\" target=\"_blank\" rel=\"noopener\">Oregon Health Authority<\/a>\u00a0have been\u00a0regulating the recreational and medical marijuana markets. The auditors found that regulators have not kept up with mandatory inspections or done enough to prevent diversions to the illicit market.<\/p>\n<p>These findings also follow a report issued last year by Oregon law enforcement with even more dramatic figures. The August study by the\u00a0<a href=\"http:\/\/oridhidta.org\/\" target=\"_blank\" rel=\"noopener\">Oregon-Idaho High Intensity Drug Trafficking Area Program<\/a>\u00a0\u2014 made up of local, state and federal agencies \u2014 found that nearly 70 percent of the legal recreational marijuana grown in Oregon is going unsold. While the study implied that much of that 70 percent is simply being trashed, it also raised the specter of illicit-market diversion.<\/p>\n<p>\u201cWhat is often lost in this discussion is the link between marijuana and serious, interstate criminal activity. Overproduction is rampant, and the illegal transport of product out-of-state \u2014 a violation of both state and federal law \u2014 continues unchecked,\u201d said Billy Williams, U.S.\u00a0Attorney for Oregon, speaking to the\u00a0<a href=\"https:\/\/www.mcall.com\/business\/mc-biz-oregon-colorado-pot-supply-20180803-story.html\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>. \u201cIt\u2019s time for the state to wake up, slow down and address these issues in a responsible and thoughtful manner.\u201d<\/p>\n<p>The AP account on the Oregon-Idaho report also noted a recent state-commissioned study by the University of Colorado Boulder that found most growers in the Centennial State were planting less than half of their legal allotment and still meeting demand, which suggests this problem is not confined to Oregon.<\/p>\n<h4>Interstate Cannabis Trade Proposal<\/h4>\n<p>A group of Oregon cultivators is proposing an unorthodox way out of this dilemma: They\u2019re lobbying legislators in Salem to pass a bill that would allow the state to enter into cannabis transfer agreements with other states. Sen. Floyd Prozanski, a Democrat from Eugene, has\u00a0<a href=\"\/could-oregon-be-the-first-to-legally-export-marijuana-to-other-states\/\">introduced such legislation<\/a>, and hopes it will pass in the coming session at the statehouse.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.craftcannabisalliance.org\/\" target=\"_blank\" rel=\"noopener\">Craft Cannabis Alliance<\/a>, a grouping of small producers, is avidly promoting the idea. \u201cThere is only one way to address this problem, and it\u2019s to demand we get access to markets around the country,\u201d Adam Smith, the group\u2019s director, told\u00a0<a href=\"https:\/\/www.bizjournals.com\/portland\/news\/2019\/01\/31\/oregons-cannabis-inventory-6-5-years-worth.html\" target=\"_blank\" rel=\"noopener\">Portland Business Journal<\/a>. \u201cThis region could and should be building a world-class industry for this product, but we can\u2019t do that under federal prohibition, no matter what we do on the margins here.\u201d<\/p>\n<p>The proposal does appear to be in a race against time, with opposite solutions also being floated.\u00a0<a href=\"\/norml-releases-governor-scorecard-ranking-state-leaders-on-cannabis-policy\/\">Gov. Kate Brown<\/a>\u00a0has submitted a bill to the state legislature that would limit new cultivation licenses.<\/p>\n<p>\u201cThe governor isn\u2019t wrong to want to look at limiting new licenses,\u201d Smith conceded. \u201cBut we need to have a conversation about the long-term vision for this industry. We need to make a plan that will reward the people who are already in the industry, investing in Oregon and struggling to survive.\u201d<\/p>\n<p>Of course, for this idea to fly, there would have to be some kind of federal acquiescence \u2014 as interstate trade would be treading on the authority of Washington, D.C. far more clearly than does intra-state.
