But advances for the right to access cannabis are on the ballot, too. This election cycle, conservative North Dakota or swing state Michigan could be the next to legalize. Amid a degree of political confusion, solidly conservative Utah and Missouri will vote on medical marijuana.<\/p>\n<p>And in swing states Ohio and Wisconsin, many localities will get to vote on non-binding measures that may nonetheless move those states closer to decriminalization or even legalization.<\/p>\n<p>Regardless of the outcomes, the fact that these measures are on the ballot in these heartland bastions is testament to the fast erosion of the cannabis stigma in American politics.<\/p>\n<h4>North Dakota and Michigan Will Consider Cannabis Legalization<\/h4>\n<p>In North Dakota, a legalization measure\u00a0<a href=\"\/cannabis-legalization-initiative-qualifies-for-the-north-dakota-ballot\/\">qualified for the ballot<\/a>\u00a0in August, as activists collected more than enough approved signatures.\u00a0<a href=\"https:\/\/ballotpedia.org\/North_Dakota_Measure_3,_Marijuana_Legalization_and_Automatic_Expungement_Initiative_(2018)\" target=\"_blank\" rel=\"noopener\">Measure 3<\/a>, the Marijuana Legalization and Automatic Expungement Initiative, is a surprisingly far-reaching measure.<\/p>\n<p>The language includes no limits on quantities \u2014 either for possession or cultivation. Those under 21-years-of-age in possession of cannabis, or those selling it to minors, would be treated the same as if the substance in question were alcohol. Most encouragingly, the measure would mandate a process to expunge the criminal records of \u201cindividuals with convictions for a controlled substance that has been legalized.\u201d<\/p>\n<p>Predictably, the measure faces plenty of opposition.\u00a0As\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/north-dakotas-marijuana-legalization-supporters-outraised-by-opponents-filings-show\/\" target=\"_blank\" rel=\"noopener\">Marijuana Moment<\/a>\u00a0reports, the measure\u2019s sponsor,\u00a0<a href=\"https:\/\/www.legalizend.com\/\" target=\"_blank\" rel=\"noopener\">LegalizeND<\/a>, has been outspent by the opposition, Healthy and Productive North Dakota (<a href=\"http:\/\/healthynorthdakota.org\/\" target=\"_blank\" rel=\"noopener\">HAPND<\/a>), by a factor of 10-to-1. The national group\u00a0<a href=\"https:\/\/learnaboutsam.org\/\" target=\"_blank\" rel=\"noopener\">Smart Approaches to Marijuana<\/a>\u00a0poured over $150,000 into HAPND (including \u201cin-kind services and resources\u201d).\u00a0Nonetheless. a\u00a0<a href=\"https:\/\/www.kvrr.com\/2018\/10\/21\/poll-finds-just-enough-support-to-pass-recreational-marijuana-in-north-dakota\/\" target=\"_blank\" rel=\"noopener\">recent poll<\/a>\u00a0conducted by\u00a0<a href=\"http:\/\/www.thekitchensgroupresearch.com\/\" target=\"_blank\" rel=\"noopener\">The Kitchens Group<\/a>\u00a0found 51 percent of likely North Dakota voters support passing Measure 3, while only 36 percent opposed it.<\/p>\n<p>Michigan is also\u00a0<a href=\"\/michigan-hash-bash-pushes-for-cannabis-legalization\/\">facing a legalization initiative<\/a>, with sufficient signatures\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/michigan-marijuana-legalization-measure-approved-for-ballot\/\" target=\"_blank\" rel=\"noopener\">approved<\/a>\u00a0in April.\u00a0<a href=\"http:\/\/www.house.michigan.gov\/hfa\/PDF\/Alpha\/Ballot_Proposal_2018-1_Marijuana_Initiative.pdf\" target=\"_blank\" rel=\"noopener\">Proposal 1<\/a>, the\u00a0Michigan Regulation and Taxation of Marihuana Act, would allow those 21 or over to possess up to 2.5 ounces on their person, and up to 10 ounces or 12 plants at home.<\/p>\n<p>Advocacy\u00a0group\u00a0<a href=\"http:\/\/www.milegalize.com\/\" target=\"_blank\" rel=\"noopener\">MiLegalize<\/a>\u00a0is again facing a tough fight from the opposition,\u00a0<a href=\"http:\/\/healthyandproductivemi.org\/\" target=\"_blank\" rel=\"noopener\">Healthy and Productive Michigan<\/a>. But a poll last month by the\u00a0<a href=\"https:\/\/www.freep.com\/story\/news\/politics\/2018\/09\/28\/poll-legal-marijuana-easier-voting-michigan\/1446391002\/\" target=\"_blank\" rel=\"noopener\">Detroit Free Press<\/a>\u00a0found over 55 percent in support of the measure, compared to some 40 percent opposed.<\/p>\n<h4>Utah and Missouri Will Consider Medical\u00a0Marijuana<\/h4>\n<p>It was a real breakthrough when promoters of a medical marijuana initiative in Utah\u00a0<a href=\"\/the-future-of-medical-marijuana-in-utah\/\">qualified for the ballot<\/a>\u00a0in April.<\/p>\n<p><a href=\"https:\/\/ballotpedia.org\/Utah_Proposition_2,_Medical_Marijuana_Initiative_(2018)\" target=\"_blank\" rel=\"noopener\">Proposition 2<\/a>, the\u00a0Utah Medical Cannabis Act,\u00a0would allow qualified patients to obtain either herbaceous cannabis or cannabis-infused products from state-licensed dispensaries. A poll last month by the group Utah Policy\u00a0<a href=\"https:\/\/www.deseretnews.com\/article\/900030613\/new-poll-suggests-a-slip-in-utahns-support-for-medical-marijuana-but-with-64-percent-still-in-favor.html\" target=\"_blank\" rel=\"noopener\">showed a comfortable 65 percent lead<\/a>.<\/p>\n<p>But there has been some political confusion around the bill, as lawmakers were seeking to head off the ballot initiative with a far more restrictive law allowing use only of CBD preparations.<\/p>\n<p>This \u201c<a href=\"https:\/\/www.parkrecord.com\/news\/summit-county\/opponents-supporters-of-prop-2-press-on-in-wake-of-medical-marijuana-compromise\/\" target=\"_blank\" rel=\"noopener\">compromise bill<\/a>\u201d has\u00a0<a href=\"https:\/\/www.hjnews.com\/news\/state\/lds-church-backs-deal-to-allow-medical-marijuana-in-utah\/article_a10a6b34-d1c9-5610-8df0-9f0aa5811ec8.html\" target=\"_blank\" rel=\"noopener\">won the support<\/a>\u00a0of the\u00a0<a href=\"https:\/\/www.lds.org\/\" target=\"_blank\" rel=\"noopener\">Church of Latter Day Saints<\/a>\u00a0(popularly known as the Mormons) \u2014 major conservative power-brokers in the state, who are opposing the ballot measure. If the ballot measure fails, the compromise bill could still provide some relief for patients in Utah \u2014 despite much\u00a0<a href=\"\/is-the-utah-medical-marijuana-compromise-a-scam-or-legitimate-deal\/\">activist skepticism<\/a>\u00a0about the motives behind it.<\/p>\n<p>Things are more confused still in Missouri. As the\u00a0<a href=\"https:\/\/www.news-leader.com\/story\/news\/politics\/elections\/2018\/09\/03\/medical-marijuana-missouri-voting-november\/1112407002\/\" target=\"_blank\" rel=\"noopener\">Springfield News-Leader<\/a>\u00a0notes,\u00a0Missouri voters will face three different medical marijuana proposals on their ballots: two constitutional amendments and one change to state law. All would allow dispensary sale to qualifying patients, but would vary in how sales will be taxed.\u00a0<a href=\"https:\/\/ballotpedia.org\/Missouri_Amendment_2,_Medical_Marijuana_and_Veteran_Healthcare_Services_Initiative_(2018)\" target=\"_blank\" rel=\"noopener\">Amendment 2<\/a>\u00a0is\u00a0supported by a group called\u00a0<a href=\"http:\/\/www.newapproachmissouri.com\/\" target=\"_blank\" rel=\"noopener\">New Approach Missouri<\/a>;\u00a0<a href=\"https:\/\/ballotpedia.org\/Missouri_Amendment_3,_Medical_Marijuana_and_Biomedical_Research_and_Drug_Development_Institute_Initiative_(2018)\" target=\"_blank\" rel=\"noopener\">Amendment 3<\/a>\u00a0is\u00a0supported by Springfield physician-attorney\u00a0<a href=\"http:\/\/www.bradbradshaw.com\/\" target=\"_blank\" rel=\"noopener\">Brad Bradshaw<\/a>; and\u00a0<a href=\"https:\/\/ballotpedia.org\/Missouri_Proposition_C,_Medical_Marijuana_and_Veterans_Healthcare_Services,_Education,_Drug_Treatment,_and_Public_Safety_Initiative_(2018)\" target=\"_blank\" rel=\"noopener\">Proposition C<\/a>\u00a0is\u00a0supported by\u00a0<a href=\"https:\/\/themissouritimes.com\/48859\/missourians-for-patient-cares-initiative-petition-for-medical-marijuana-takes-a-lead-in-fundraising\/\" target=\"_blank\" rel=\"noopener\">Missourians for Patient Care<\/a>.<\/p>\n<p>Under Missouri law, if multiple \u201cconflicting\u201d amendments or measures are approved by the voters, the one winning the greatest number of votes prevails.<\/p>\n<h4>Local Decriminalization Measures On the Ballot in Wisconsin and Ohio<\/h4>\n<p>In Wisconsin and Ohio, there are no statewide ballots on cannabis, but voters in many localities will get to cast a vote of support for cannabis legalization or decriminalization.<\/p>\n<p>In Wisconsin, 16 counties and two cities face referendum questions concerning cannabis decriminalization, as the\u00a0<a href=\"https:\/\/www.jsonline.com\/story\/news\/politics\/elections\/2018\/10\/08\/voters-guide-voting-marijuana-referendums-nov-6-ballots\/1435857002\/\" target=\"_blank\" rel=\"noopener\">Milwaukee Journal Sentinel<\/a>\u00a0reports. All are \u201cadvisory referendums,\u201d and their passage would not require the state legislature to take action. But advocates and lawmakers alike are looking to them as a measure of public opinion on the question.<\/p>\n<p>Voters in Wisconsin\u2019s Dane, La Crosse and Rock counties will also get to voice their yea or nay on legalizing personal use of cannabis for adults 21 years and older. Ten counties and the City of Waukesha focus their ballot questions on medical marijuana. Eau Claire and Racine counties have included multiple questions on medical or general legalization, while the City of Racine has added an option for decriminalization.<\/p>\n<p>In Ohio, voters in six municipalities will face local initiatives on decriminalization: Dayton, Fremont, Garrettsville, Norwood, Oregon and Windham.\u00a0As\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cities-across-ohio-will-vote-on-marijuana-decriminalization-in-november\/\" target=\"_blank\" rel=\"noopener\">Marijuana Moment<\/a>\u00a0notes, these measures won\u2019t change state law, but will deprioritize enforcement in those localities \u2014 as well as sending a message to lawmakers.<\/p>\n<p>Ohio already has a\u00a0<a href=\"http:\/\/norml.org\/laws\/item\/ohio-penalties-2\" target=\"_blank\" rel=\"noopener\">partial decriminalization<\/a>, with jail time eliminated for up to 150 grams, but a 30-day sentence applicable for between 150 and 250. Possession is considered a misdemeanor in any amount. In Wisconsin, the\u00a0<a href=\"http:\/\/norml.org\/laws\/item\/wisconsin-penalties-2\" target=\"_blank\" rel=\"noopener\">law is harsher<\/a>, with a six-month term possible for possession of any amount, and a second offense jacked up to a felony.
