{"id":24191,"date":"2018-03-05T06:00:05","date_gmt":"2018-03-05T14:00:05","guid":{"rendered":"http:\/\/cannabiscultivatornews.com\/home\/index.php\/2018\/03\/05\/canada-introduces-sin-tax-on-medical-marijuana\/"},"modified":"2018-03-05T12:38:22","modified_gmt":"2018-03-05T20:38:22","slug":"canada-introduces-sin-tax-on-medical-marijuana","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2018\/03\/05\/canada-introduces-sin-tax-on-medical-marijuana\/","title":{"rendered":"Canada Introduces \u2018Sin Tax\u2019 on Medical Marijuana"},"content":{"rendered":"<\/p>\n<h4>In Canada\u2019s new federal budget, the country set up a tax framework that would tax adult-use and medical cannabis at the same high level.<\/h4>\n<hr \/>\n<p><span class=\"wpsdcp-drop-cap-default\">M<\/span>edical marijuana patients in the Great White North are fuming after learning the Canadian government included medical marijuana taxes in its federal budget.<\/p>\n<p>In the budget released on Monday, Feb. 26, the Canadian government confirmed that it would be applying a 10 percent excise tax to all cannabis \u2014 both for medical patients and adult users.<\/p>\n<p>Leading the calls against the move is <a href=\"https:\/\/cfamm.ca\/\" target=\"_blank\" rel=\"noopener\">Canadians for Fair Access to Medical Marijuana<\/a> (CFAMM), an Ontario-based non-profit focused on supporting medical cannabis patients. The non-profit has been campaigning against the idea of taxing the sick since the idea <a href=\"https:\/\/www.fin.gc.ca\/n17\/17-114-eng.asp\" target=\"_blank\" rel=\"noopener\">was first floated<\/a> by the Minister of Finance last November.<\/p>\n<p>\u201cWe have heard from tens of thousands of patients across the country,\u201d said Jonathan Zaid, Executive Director of CFAMM <a href=\"https:\/\/www.newswire.ca\/news-releases\/patients-outraged-to-see-medicine-taxed-in-federal-budget-675331883.html\" target=\"_blank\" rel=\"noopener\">in a statement<\/a>. \u201cThis new tax adds insult to injury for a community of patients already struggling to afford their medicine.\u201d<\/p>\n<p>The main reason behind the new wave of criticism from patients is the fact all of the cannabis products sold under <a href=\"https:\/\/www.fin.gc.ca\/n17\/data\/17-114_1-eng.asp\" target=\"_blank\" rel=\"noopener\">Canada\u2019s proposed Cannabis Act<\/a> for medical purposes will be subject to the taxes and conditions of the general legal-pot structure being constructed in Ottawa, the capital city of <a href=\"https:\/\/cannabisnow.com\/tag\/canada\/\">Canada<\/a>. People growing their own medicine will only be taxed at the point of sale for their seeds or starter plants.<\/p>\n<p>Zaid also mentioned the border-transcending fact that medical cannabis patients rarely have the cost of their medicine covered by insurance and it is also the only medicine to which a sales tax is applied.<\/p>\n<p>\u201cA recent Environics poll found that a majority of Canadians (62 percent) are opposed to taxing medical cannabis,\u201d said Zaid. \u201cAnd to date, over 16,000 Canadians and a group of 12 non-profits have advocated for the elimination of it. Despite this fierce opposition, the federal government decided to forge ahead, implementing the new tax in its federal budget.\u201d<\/p>\n<p>The government did decide to exempt \u201clow-THC cannabidiol [CBD] oils, which are sometimes used with children facing certain medical conditions,\u201d <a href=\"https:\/\/www.civilized.life\/articles\/canada-doubles-down-on-medical-marijuana-tax-but-exempts-certain-products\/\" target=\"_blank\" rel=\"noopener\">according to Civilized<\/a>. But Zaid said this will only help the small minority of patients that use those products.<\/p>\n<blockquote>\n<p>\u201cIt\u2019s quite clear that Canadians understand that taxing medical cannabis is unfair and wrong,\u201d said Zaid.<\/p>\n<\/blockquote>\n<p>\u201cExempting a small minority of patients does not address the affordability issue and implies some patients are more legitimate than others,\u201d said Zaid. \u201cLooking into a reimbursement program implies patients can afford to pay for their medicine in the first instance. They can\u2019t.\u201d<\/p>\n<p>Besides the taxes, the medical aspects of the government\u2019s pot plan are pretty decent. CFAMM said they\u2019re pleased to see it include Health Canada evaluating the drug review and approval process to ensure it keeps up with cannabis developments. However, they are urging the government to commit to meaningful timelines and research.<\/p>\n<p>David Berg, the president and chief technology officer of the Canadian tech company Strainprint, called the issue contentious and backed the efforts of CFAMM and other organizations working to convince the government and Health Canada to go in another direction.<\/p>\n<p>\u201cA purchase of cannabis will be subject to local sales taxes province by province, and then a federal tax levy of about $1 per gram,\u201d said Berg. \u201cThere is currently no differential between taxes for recreation or medical patients.\u201d<\/p>\n<p>The actual tax revenue patients, and everyone else, will produce has been a hot issue in its own right. In December, the government announced an agreement that would send 75 cents of every dollar collected from cannabis during the first two years to the provinces. At the time, <a href=\"http:\/\/www.cbc.ca\/news\/politics\/finance-ministers-pot-tax-1.4442540\" target=\"_blank\" rel=\"noopener\">the Canadian Broadcasting Company noted<\/a> that was a big jump from the 50-50 split the federal government had proposed as recently as November.<\/p>\n<p>Marshall Rutman, vice president of marketing at the medical cannabis company <a href=\"http:\/\/resolvedigitalhealth.com\" target=\"_blank\" rel=\"noopener\">Resolve Digital Health<\/a>, said that he thinks the Canadian government is concerned that \u201crecreational users may try to obtain prescriptions in order to avoid paying taxes.\u201d<\/p>\n<p>\u201cI feel that legitimate cannabis patients shouldn\u2019t have to pay more for their prescribed medicine because of the fear that the system will be abused,\u201d said Rutman. \u201cWe should be ensuring adequate checks and balances are in place at the point of prescription, then trusting physicians to discern whether a medical need exists.
