{"id":22587,"date":"2018-01-05T16:00:46","date_gmt":"2018-01-06T00:00:46","guid":{"rendered":"http:\/\/cannabiscultivatornews.com\/home\/index.php\/2018\/01\/05\/vermont-lawmakers-ignore-sessions-vote-to-legalize-marijuana\/"},"modified":"2018-01-06T12:37:34","modified_gmt":"2018-01-06T20:37:34","slug":"vermont-lawmakers-ignore-sessions-vote-to-legalize-marijuana","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2018\/01\/05\/vermont-lawmakers-ignore-sessions-vote-to-legalize-marijuana\/","title":{"rendered":"Vermont Lawmakers Ignore Sessions, Vote to Legalize Marijuana"},"content":{"rendered":"<\/p>\n<h4>Lawmakers in the Green Mountain State moved closer to becoming the first body of elected officials to legalize marijuana without the help of a ballot initiative, but the job isn\u2019t yet done.<\/h4>\n<hr \/>\n<p><span class=\"wpsdcp-drop-cap-default\">U<\/span>nfazed by the fury and worry emanating from Washington, D.C., Vermont\u2019s House of Representatives on Thursday\u00a0approved a bill that would legalize recreational marijuana for adults 21 and over.<\/p>\n<p>Vermont has been on the cusp of legalizing cannabis since last May, thanks to its elected legislature \u2014 which would make Sen. Bernie Sanders\u2019s home state the first in the union to legalize cannabis via the normal lawmaking process and not voter initiative.<\/p>\n<p>Back in May, citing small quibbles and not any sort of \u201cphilosophical\u201d opposition to cannabis legalization,\u00a0<a href=\"https:\/\/cannabisnow.com\/vermont-legalization-deal-likely-week\/\">Gov. Rick Scott vetoed a legalization bill<\/a>\u00a0approved by both houses of the state legislature.<\/p>\n<p>Negotiations on a compromise bill have been ongoing ever since. The results of that effort, H. 511, would allow adults 21 and over to possess up to an ounce of cannabis and cultivate a small amount of cannabis at home.<\/p>\n<p>That bill now heads to the state Senate, which approved a very similar compromise effort last summer. Barring any unforeseen delays or last-minute concerns, the current bill should then head back to Scott\u2019s desk for final approval.<\/p>\n<p><a href=\"http:\/\/www.burlingtonfreepress.com\/story\/news\/politics\/government\/2018\/01\/04\/vermont-house-vote-marijuana-legalization-thursday\/1003206001\/\" target=\"_blank\" rel=\"noopener\">As the Burlington Free Press reported<\/a>, H.511 would not create a regulated and taxed marketplace like the one that launched Jan. 1 in California, and the ones approved by voters \u2014 but still in the planning stages \u2014 in nearby Massachusetts and Maine.<\/p>\n<p>All that, in theory, would come later \u2014 but how willing lawmakers will be to buck the federal Justice Department, which announced <a href=\"https:\/\/cannabisnow.com\/jeff-sessions-rescinds-obama-era-pot-protections\/\">the revocation of Obama-era marijuana-friendly policy documents<\/a> on Thursday, is an open question.<\/p>\n<blockquote>\n<p>For now, the bill allows adults 21 and older to possess up to one ounce of marijuana and grow their own plants at home, and does not impose any taxes.<\/p>\n<\/blockquote>\n<p>Headed into debate on Thursday, H.511 was \u201cwidely expected\u201d to pass, the Free Press noted, but had to survive several efforts to delay the vote altogether or substantially change the bill, some of which cited Attorney General Jeff Sessions\u2019s rescinding of the so-called Cole Memo.<\/p>\n<p>Some lawmakers wanted to delay legalization\u2019s effective date until summer of 2019, or hold off until Vermont State Police developed an effective roadside test for <a href=\"https:\/\/cannabisnow.com\/tag\/driving-high\/\">drivers impaired by marijuana<\/a> (something no other police force has managed to do). Others wanted to wait until a report from a legalization commission that answers to Gov. Scott, and still others wanted more data from Colorado, the newspaper reported.<\/p>\n<p>It\u2019s not clear what data points lawmakers were waiting for \u2014 or what unanswered questions would be satisfied.<\/p>\n<p>\u201cThis is a thoughtful, incremental approach to marijuana legalization,\u201d said House Majority Leader Jill Krowinski, D-Burlington in a statement, as per the Free Press. \u201cWe\u2019re proud to be the first state in the nation to pass marijuana legalization without the pressure of a public referendum.\u201d<\/p>\n<p>It\u2019s also unclear if Gov. Scott or state senators will suddenly discover cold feet as a result of Sessions\u2019s move.
