{"id":20358,"date":"2017-10-18T15:00:08","date_gmt":"2017-10-18T23:00:08","guid":{"rendered":"http:\/\/cannabiscultivatornews.com\/home\/index.php\/2017\/10\/18\/crowdfunding-site-reverses-fire-fund-for-ca-cannabis-growers\/"},"modified":"2017-10-19T12:41:50","modified_gmt":"2017-10-19T20:41:50","slug":"crowdfunding-site-reverses-fire-fund-for-ca-cannabis-growers","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2017\/10\/18\/crowdfunding-site-reverses-fire-fund-for-ca-cannabis-growers\/","title":{"rendered":"Crowdfunding Site Reverses Fire Fund for CA Cannabis Growers"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"http:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2017\/10\/1f49a-2.png\" width=\"72\" height=\"72\"> <\/p>\n<h4>WePay has reversed the funds raised by the California Growers Association, in what cannabis industry insiders are calling undue discrimination.<\/h4>\n<hr \/>\n<p><span class=\"wpsdcp-drop-cap-default\">F<\/span>ederal prohibition continues to exacerbate the pain of cannabis farmers who have lost everything in the Northern California fires that continue to burn and have killed 42 people, burned thousands of homes and scorched a hundred thousand acres of land since Oct. 9. The federal illegality of cannabis has made crop insurance inaccessible for farmers \u2014 and now, the banking limitations on the cannabis industry are impacting the community\u2019s crowdfunding efforts to support farmers.<\/p>\n<p>On Monday, the <a href=\"http:\/\/www.calgrowersassociation.org\/\" target=\"_blank\" rel=\"noopener\">California Grower\u2019s Association<\/a> announced that <a href=\"https:\/\/www.youcaring.com\/growersincaliforniawhohavebeenimpactedbywildfires-977705\" target=\"_blank\" rel=\"noopener\">their relief fund on the YouCaring platform<\/a> had all of its donations reversed, effectively sending back all the money the CGA had earned.<\/p>\n<p>CGA Executive Director Hezekiah Allen <a href=\"https:\/\/www.facebook.com\/hezekiah.allen\/posts\/1696249623740211?pnref=story\" target=\"_blank\" rel=\"noopener\">took to Facebook<\/a> to share the bad news with supporters and friends.<\/p>\n<p \/>\n<p>\u201cWas just informed by the payment processor for the wildfire relief fund that they have reversed the payments because they can\u2019t process \u2018cannabis transactions,\u2019\u201d Allen said. \u201cI didn\u2019t realize contributions to wildfire recovery were considered \u2018cannabis transactions.\u2019\u201d<\/p>\n<p>The takedown letter Allen received on Monday claimed he had broken the platform\u2019s Terms of Service and would no longer be able to access YouCaring\u2019s payment processing platform WePay or the $10,000 the campaign had raised at that point, which was supposed to help victims of the devastating wildfires across the state that have been burning for a week. YouCaring <a href=\"http:\/\/www.sfweekly.com\/news\/wepay-wipes-out-marijuana-wildfire-relief-fund\/\" target=\"_blank\" rel=\"noopener\">elaborated further<\/a>,<\/p>\n<p class=\"v2-processed\" style=\"padding-left: 30px\"><em>\u201cMore specifically:<\/em><\/p>\n<p class=\"v2-processed\" style=\"padding-left: 30px\"><em>Current U.S. federal law prohibits the purchase and sale of cannabis and cannabis extracts. Subsequently, WePay is unable to process payments connected to the production, sale, or consumption of cannabis, even in situations where such activities would be permitted under state law.<\/em><\/p>\n<p class=\"v2-processed\" style=\"padding-left: 30px\"><em>Thank you for understanding and we apologize that we couldn\u2019t offer a better solution.\u201d<\/em><\/p>\n<p>We reached out to YouCaring to find out how supporting a wildfire fund coordinated by an industry trade group that as an entity doesn\u2019t touch the plant might be construed as a cannabis transaction that would be against the law. YouCaring was quick to point out that WePay was to blame for the reversal.<\/p>\n<p>\u201cYouCaring did not shut down this fundraiser, WePay suspended the account,\u201d YouCaring Head of Communications Camelia Gendreau told Cannabis Now in an email. \u201cThe fact that you can still see the fundraiser on our website tells you that we didn\u2019t shut it down \u00a0\u2014 when our trust and safety team takes down a campaign, it disappears from our website completely.\u201d<\/p>\n<p>Gendreau then noted this wasn\u2019t not meant to be a swipe at cannabis. \u201cWhile YouCaring support[s] all forms of treatment and most fundraiser types, our payment providers (WePay &amp; PayPal) do not allow fundraisers for anything marijuana-related, including for medical reasons,\u201d she said.<\/p>\n<p>When Gendreau was asked again how the fund might be construed as a cannabis transaction, she responded, \u201cThat\u2019s really a question for WePay. The campaign is still up on YouCaring, so the proof is in the pudding, so to say.\u201d<\/p>\n<p>When asked about how this fund could be seen as criminal activity Jeremy Milk of WePay gave a confusing answer.<\/p>\n<p>\u201cTo comply with federal law and related government notices, WePay\u2019s bank and card association partners prohibit us from processing payments related to marijuana,\u201d he said. \u201cThis means we can process payments for campaigns to support growers\u2019 families, but not to support their cannabis crops. We recognize that enforcement of our Terms of Service may impact some campaigns, yet we must comply with federal laws.\u201d<\/p>\n<p>We pointed out to Milk the funds raised haven\u2019t been claimed as some kind of replace-the-weed fund. If the organizer were to state clearly and unambiguously that the campaign will support persons adversely impacted, the platform would very likely be able to start processing their payments.<\/p>\n<p>Morgan Fox of the D.C.-based <a href=\"https:\/\/www.mpp.org\/\" target=\"_blank\" rel=\"noopener\">Marijuana Policy Project<\/a> said that it\u2019s not abnormal for crowdfunding websites to shut down campaigns somewhat related to cannabis.<\/p>\n<p>\u201cThis sort of thing isn\u2019t unheard of, and I guess I can understand their fear of possibly being accused of money laundering or some other federal crime,\u201d said Fox. \u201cHowever, I have never heard of a legitimate charity being penalized or prosecuted for taking money from the cannabis industry.\u201d<\/p>\n<blockquote>\n<p>\u201cFrankly, I think it is ridiculous that this donation was reversed, particularly since cannabis growers have been hit very hard by this tragedy,\u201d Fox said.<\/p>\n<\/blockquote>\n<p>Fox says in cases like this, he\u2019s seen industry actors that want to do charitable activities and <a href=\"https:\/\/cannabisnow.com\/help-victims-norcal-fires\/\">give back to the communities that support them<\/a> have been forced to do the work themselves or form their own independent charities. \u201cJust another example of discrimination on the part of the system breeding innovation from the cannabis community,\u201d he said.<\/p>\n<p>This independent fundraising is exactly what the folks at <a href=\"https:\/\/www.cannacraft.com\/\" target=\"_blank\" rel=\"noopener\">CannaCraft<\/a> have done to help facilitate their ongoing relief effort. They\u2019ve already offered up their facility as <a href=\"https:\/\/cannabisnow.com\/cannabis-behind-fire-line\/\">a regional command center for The Red Cross<\/a>.
