{"id":19181,"date":"2017-09-07T05:00:38","date_gmt":"2017-09-07T13:00:38","guid":{"rendered":"http:\/\/cannabiscultivatornews.com\/home\/index.php\/2017\/09\/07\/the-great-california-pot-t-shirt-ban-is-dead\/"},"modified":"2017-09-07T12:58:49","modified_gmt":"2017-09-07T20:58:49","slug":"the-great-california-pot-t-shirt-ban-is-dead","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2017\/09\/07\/the-great-california-pot-t-shirt-ban-is-dead\/","title":{"rendered":"The Great California Pot T-Shirt Ban is Dead"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"http:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2017\/09\/marijuanat-shirts@2x-1024x661-1.jpg\" width=\"1024\" height=\"661\"> <\/p>\n<h4>A bill that proposed banning cannabis marketing has died, but may return next year.<\/h4>\n<hr \/>\n<p><span class=\"wpsdcp-drop-cap-default\">A<\/span> yes vote on a bill that was set to limit cannabis marketing in the Golden State, Senate Bill 162, failed to meet an important Sept. 1 deadline that would have given lawmakers two more weeks to pass it. The bill would have put major restrictions on the way cannabis businesses would be allowed to market to consumers in California\u2019s forthcoming legal recreational market by banning everything from clothing to billboards.<\/p>\n<p>SB 162 was sponsored by Santa Monica State Senator Ben Allen and was being backed the American Academy of Pediatrics and the California Police Chiefs Association. The death of the bill last week was a bit of a surprise to Allen and even advocates who, a few weeks ago, presumed it would be tough for members of the California legislature to vote no on this kind of \u201csave the children\u201d proposal. Allen told the <a href=\"http:\/\/www.latimes.com\/politics\/essential\/la-pol-ca-essential-politics-updates-lawmakers-shelve-bill-to-limit-1504293067-htmlstory.html\" target=\"_blank\" rel=\"noopener\">Los Angeles Times<\/a>:<\/p>\n<p>\u201cThe Legislature in the past has wisely prohibited advertising with branded merchandise by tobacco companies, expressly because items like hats and T-shirts are known to entice kids to smoke. This was a commonsense measure to apply similar restrictions that would help prevent marijuana use by teens.\u201d<\/p>\n<p>The <a href=\"http:\/\/www.cacannabisindustry.org\/\" target=\"_blank\" rel=\"noopener\">California Cannabis Industry Association<\/a> was among those in Sacramento standing against the bill as they believe the concept of advertising to children is irresponsible and was a topic that was covered clearly by Proposition 64 last fall, when voters legalized marijuana for adult recreational use.<\/p>\n<p>\u201cOur members are very happy, CCIA did stand in opposition,\u201d said CCIA Communications and Outreach Director Josh Drayton. \u201cIt\u2019s not that our members don\u2019t accept and support reasonable solutions to issues that are arising but on this one, we felt Prop 64 made it pretty clear the cannabis industry could not be marketing to minors.\u201d<\/p>\n<p>Some of the language in SB 162 wasn\u2019t crazy, but the branding stuff seemed to go a bit overboard, we asked Drayton his take on the balance of it all.<\/p>\n<p>\u201cThere were so many loopholes in [the bill] as well,\u201d he said. \u201cOne thing is they\u2019re trying to put these restrictions on companies following heavy regulations while you can go down to a skate or surf shop and buy something with a pot leaf all over it, as long as it wasn\u2019t representing a brand.\u201d<\/p>\n<p><a href=\"https:\/\/cannabisnow.com\/wp-content\/uploads\/2017\/09\/marijuanat-shirts@2x.jpg\"><img loading=\"lazy\" class=\"size-large wp-image-24870 aligncenter\" src=\"http:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2017\/09\/marijuanat-shirts@2x-1024x661.jpg\" alt=\"\" width=\"960\" height=\"620\" \/><\/a><\/p>\n<p>In Drayton\u2019s eyes, there are a lot of factors in play for whether the bill will have legs next year.<\/p>\n<p>\u201cWe\u2019re going to wait to see how the [legalization] rollout really happens,\u201d he said. \u201cI think there are going to be obstacles and hurdles that we haven\u2019t anticipated as of yet. Those are going to need immediate fixing. Then we\u2019re going to see some long term cleanup language for many different issues that will pop up.\u201d<\/p>\n<p>When asked how that might apply to SB 162 specifically, he couldn\u2019t say, but noted, \u201cit\u2019s all on the table.\u201d<\/p>\n<p>Aaron Smith, executive director of the <a href=\"https:\/\/thecannabisindustry.org\/\" target=\"_blank\" rel=\"noopener\">National Cannabis Industry Association <\/a>feels other adult products have laid out a pretty clear road map for cannabis.<\/p>\n<p>\u201cI think we could already look to a product like alcohol,\u201d Smith said. \u201cWhile alcohol is far more dangerous, it\u2019s a precedent. It\u2019s an adult product that does have some limitations on advertising. I think that should be kind of a starting point.\u201d<\/p>\n<p>We asked Smith if, in that context, cannabis brands should be allowed in retail clothing stores alongside Budweiser and Jack Daniels apparel.<\/p>\n<p>\u201cAgain I\u2019d say it\u2019s an adult product and should be treated as such,\u201d said Smith. \u201cThere should be no question marketing to children is unacceptable and not in the spirit of the law which was to regulate and control cannabis in a manner similar to alcohol.
