What\u2019s going on?<\/h4>\n<hr \/>\n<p><span class=\"wpsdcp-drop-cap-default\">L<\/span>egal cannabis\u00a0sales in Nevada are set to <a href=\"https:\/\/cannabisnow.com\/nevada-recreational-rollout-still-schedule-july-1\/\">start this July<\/a>, but the Department of the Interior\u2019s Bureau of Land Management will be showing <em>no love<\/em> to the state\u2019s new cannabis users: A microscopic 10 nanograms of cannabis\u00a0per milliliter of urine (or 2 ng\/ml of blood) will get you popped if you\u2019re behind the wheel, according to <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2017-06-28\/pdf\/2017-13542.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">a statement<\/a> in today\u2019s Federal Register.<\/p>\n<p>Law enforcement will conduct the tests at their own discretion, but also at BLM\u2019s request, based on guidelines listed in today\u2019s announcement. Erratic driving or possession of anything falling under the notoriously broad category of \u201cdrug paraphernalia\u201d appear to be the chief \u201cred flags\u201d that will initiate these encounters.<\/p>\n<p>What\u2019s\u00a0more ludicrous than leaving your rolling papers in plain sight, ultimately forcing you to pee in a cup? The state\u2019s standard for <em>how much<\/em> pot you can have in your system: A nanogram is a <em>billionth\u00a0<\/em>of a gram \u2014 most of the smallest edibles in California have about two milligrams of THC in them. If 1 percent of that remains in your system when you\u2019re behind the wheel, it\u2019ll be considered a DUI. And anyone who smokes a joint the second half of that week will likely fail with such a low testing threshold, high or not.<\/p>\n<p>We reached out to leading cannabis legal theorist (and our <a href=\"https:\/\/cannabisnow.com\/best-cannabis-2016\/\">2016 Activist of the Year<\/a>), Attorney Lauren Vazquez, to give us the breakdown of what the feds are up to.<\/p>\n<p>\u201cIt looks to me like they are setting a standard for drivers on the playa. It does say probable cause is required,\u201d Vazquez said. \u201cThis is a rule making proposal and will soon be open to public comment and, hopefully, revisions. Knowing burners there\u2019s going to be a lot of talks. I\u2019m more concerned about the laser prohibition on page four: Never leave home without your laser!\u201d<\/p>\n<p>She added that not many people are going to be driving during the event anyway.<\/p>\n<p>We also spoke to Vazquez about the ridiculously low THC threshold for DUI; isn\u2019t this going to criminalize a lot of people?<\/p>\n<p>\u201cIt\u2019s only on the playa, and it takes probable cause to search the driver by saliva or blood or urine,\u201d she said. \u201cJust being at burning man is not probable cause \u2014 they have to smell weed, see you driving badly or see you doing drugs while driving before they can test you. So just sitting in line on the way out is safe.\u201d<\/p>\n<p>She added that the situation could technically have been worse.<\/p>\n<p>\u201cAt least they wrote in the probable cause standard and we don\u2019t have to argue about that,\u201d she said.<\/p>\n<p>While\u00a0still in the formative stages, this policy would ultimately place the power all in the hands of a sheriff\u2019s department that, last year, oversaw 46 arrests \u2014 37 of which were drug-related.<\/p>\n<p>Pershing County Sheriff, Jerry Allen, told the <a href=\"http:\/\/www.rgj.com\/story\/life\/arts\/burning-man\/2016\/09\/29\/sheriff-most-48-burning-man-arrests-were-drug-related\/91173770\/\" target=\"_blank\" rel=\"noopener noreferrer\">Reno-Gazette Journal<\/a> cannabis accounts for the majority of drugs his deputies found on the playa.<\/p>\n<p>\u201cThe most common drug found at Burning Man this year was marijuana,\u201d he said, \u201cfollowed by cocaine, ecstasy and acid.\u201d<\/p>\n<p>The arrest rate has skyrocketed in recent years; up from just seven people in 2014.
